YOU AGREE AND ACKNOWLEDGE THAT THE BELOW TERMS APPLY TO ALL PASSENGERS, PARTICIPANTS, GUESTS, AND STAFF:
- I have read and accept the below Event Terms & Conditions and agree to be bound by these terms.
- I acknowledge that the laws that regulate the necessary travel documentation are subject to change and that it is my responsibility to be aware of what is required for travel.
- I understand that the Cruise Line reserves the right to alter the itinerary due to adverse weather, safety concerns, port closings, or mechanical issues. NurseCon at Sea will work closely with the Cruise Line to preserve the scheduled itinerary and will communicate any changes to guests at the earliest opportunity.
- I understand that pregnant guests will only be permitted to sail if pregnant for 23 weeks or less as of the last day of the cruise. This policy is in place for the safety of the guest.
- I acknowledge that a COVID-19 vaccine and negative test is currently required by all guests to sail on this event. I have reviewed the Cruise Line’s health and safety protocols (ncl.com/safe, royalcaribbean.com/the-healthy-sail-center), acknowledge they are subject to change, and agree to comply with COVID-19 Policies and Procedures in place at the time of sailing.
- Individuals who do not comply with COVID-19 requirements will be denied boarding or disembarked from the cruise and will not be eligible for a refund.
- I acknowledge that no refunds or future credits will be issued for guests who decide after booking that they prefer not to sail for any reason including but not limited to concerns over safety or health protocols.
- I acknowledge that no refunds will be issued if the event is cancelled or postponed by NurseCon at Sea or Cruise Line. Only future credits will be given in such circumstances, which are only valid for NurseCon at Sea events, and credits do have limitations as stated in the Event Terms & Conditions.
- I acknowledge that no refunds or future credits will be issued if I fail to comply with health & safety protocols, customs and government requirements, interruptions in travel, violations of conduct policies, and other potential issues that may arise before, during, or after the event.
- I agree to abide by the payment option that I select during registration and I acknowledge that all payments are non-refundable.
EVENT TERMS & CONDITIONS
ALL BILLING AND TRAVEL SERVICES PROVIDED BY NURSECON AT SEA LLC
NURSECON AT SEA LLC is registered with the State of Florida as a Seller of Travel. Registration No. ST43371. CLIA #00038970
These Participation and Reservation Terms and Conditions (the “Terms”) constitute an Agreement between the Parties. The Parties are:
- You (“you” or “your” or “passenger” or “participant” or “guest”), on the one hand, and
- Nursecon At Sea, LLC, (“NurseCon At Sea”) on the other hand, where NurseCon At Sea, LLC puts on themed events called NurseCon At Sea (“Event”) which are scheduled to take place on various Cruise Ships (“Ship” “Vessel” or “Cruise Ship”) operated by various Cruise Lines (“Cruise Line”).
The Terms apply to all passengers, participants, guests, staff (hereinafter “you,” “your,” “Participant,” “Passenger”, “Guest” and any derivation thereof) and others attending the Event, including but not limited to anyone purchasing a reservation (“Reservation”) for the Event. By obtaining your Reservation you acknowledge and agree to the Terms, now and as they may change from time-to-time.
You expressly acknowledge and agree that (a) you are purchasing a ticket/package for the Event from NurseCon at Sea LLC, and not from any other party; (b) NurseCon At Sea, LLC is not responsible or liable to you for any claims arising from or related to the Event in any manner whatsoever; and (c) NurseCon at Sea is a full ship charter, which is vastly different from a standard cruise line sailing, and that by registering you are paying an Event Fee for a ticket/package for the Event.
Your decision to pay a deposit to book a cabin/purchase a Reservation and/or attend the Event constitutes your acknowledgment of and consent to all of the Terms, including the limitations of liability presented herein. Any and all disputes and claims whatsoever related to, or involving Nursecon At Sea and/or the Event shall be governed by Florida law and the venue for any litigation shall be in Orange County, Florida.
NurseCon At Sea Reservations are strictly nonrefundable. NurseCon At Sea recommends that you purchase travel insurance to cover any unfortunate circumstances which may arise that would cause you to have to cancel, expose you to charges which may be unanticipated, or seek a refund for the Event. Travel insurance is a relatively small investment for the protection it provides, and is recommended to all participants, event staff, and guests of any kind.
Please note that the Event Terms & Conditions and Cruise Line Ticketing Contract may change from time-to-time, particularly as CDC guidelines and the Ship’s and Cruise Line’s own terms and conditions change due to best health practices and other matters. Nursecon At Sea may advise you of recent updates and changes to the Terms, but it is each Participant’s responsibility to keep up to date with the Terms as they change from time-to-time.
It is each Participant’s responsibility and obligation to keep his/her contact information (email address, phone number, street address, etc.) up-to-date with NurseCon At Sea. There may be important or even URGENT announcements and information regarding your account or other matters, and if NurseCon At Sea cannot reach you, you will not have the benefit of such knowledge. The information may include account or other information that directly affects your reservation status or another crucial fact, and NurseCon At Sea hereby disclaims responsibility for delivering such information when a Participant’s account information is incomplete or inaccurate. It is Participant’s responsibility to verify the delivery of such communications, such as managing spam folders and other email filters.
Cruise Line Ticket Contract & Strict Limitations on NurseCon at Sea Liability. You hereby acknowledge and agree that the Cruise Line has full and exclusive control of the Vessel where the Event will take place, that the Cruise Line, not NurseCon at Sea, is responsible for providing all services to you within that Vessel and that therefore the Cruise Line, not NurseCon at Sea, shall be solely responsible for any and all liability, loss, expense, damages, or claims arising out of or related to any act, conduct or omission occurring while you are on board the Vessel. NurseCon at Sea, in its capacity as a charterer, has no such control or ability to provide you such and as such shall have no responsibility for the acts and omissions of Cruise Line.
You hereby further acknowledge and agree that, in addition to the terms and conditions of this Agreement, you will be bound by the Cruise Line’s Ticket Contract and by the general terms and conditions of Cruise Line’s program and guest policy or other policies, terms and conditions of the Cruise Line’s Ticket Contract.
You hereby agree to hold NurseCon at Sea free of responsibility for any delay, claim, liability, loss or accident occasioned by the fault or negligence of any Cruise Line or other person or company entrusted with such service.
By making your reservation and agreeing to utilize the services of NurseCon at Sea and the Cruise Line, you agree that neither NurseCon at Sea nor the Cruise Line, nor their respective affiliates, agents, principals, employees, or representatives shall be liable for any loss, injury, or damage to you or your belongings, or otherwise in connection with any accommodations, transportation, or cruise, or for trip cancellations, delays, changes in itinerary or schedule, or other services whether or not resulting directly or indirectly from any occurrence beyond their control, including without limitation, Acts of God, breakdown of the Vessel, hostilities, blockades, labor conflicts, strikes aboard ship or on land, war, fire, collision, arrest, order or restraint by governmental authorities or others, acts of terrorism, civil commotions, weather conditions and considerations of safety of the Vessel, illness, viral, bacterial or illness outbreaks and pandemics, travel-related issues, loss of employment and/or duplicate purchaser or other circumstances.
With the exception of its cancelation and refund policies, the rules, regulations and policies of the Cruise Line govern your boarding/embarkation upon the Ship, your stay on the Ship, your attendance at the Event, your departure/disembarkation from the Ship, your passage through any Port, and other crucial factors. To the extent that any of the Cruise Line’s rules, regulations and policies differ from those of Nursecon At Sea and/or the Terms, the Cruise Line’s rules, regulations and policies will supersede, with the exception of cancelation and refund policies. It is each Participant’s responsibility to know and adhere to Nursecon At Sea’s and the Cruise Line’s rules, regulations and policies, as they may change from time-to-time.
Licensed NurseCon At Sea Reservations. NurseCon At Sea and its agents and representatives are the sole creators, sellers and distributors of Nursecon At Sea Reservations. Any Reservation(s) not created by and legally acquired from Nursecon At Sea or its authorized agents or representatives will be considered fraudulent and invalid, and subject to revocation with no refund available to any party. NurseCon At Sea reserves the right to pursue any and all legal action available against any person or entity involved in the actual or attempted creation, dissemination or use of an unauthorized Reservation.
Payment Plan Terms. NurseCon At Sea Payment Plans may be offered to assist Participants with the cost of Reservations. Payment Terms shall be displayed and agreed upon during the Reservation process. Failure to make a scheduled payment within 45 days of due date will result in immediate revocation and cancellation of Reservation without refund. NurseCon At Sea shall then have the right to resell such Reservation and/or accommodation, with the original payment therefor converting in its entirety to an administrative fee. All Reservations MUST be paid in full no later than 60 days prior to Event start date. Reservations that are past due within 60 days of Event start date will be cancelled without refund. If Participant is paying for Nursecon At Sea via a payment plan, and any given payment, charge, debit or other payment is declined, charged back, or returned with not sufficient funds, such Participant’s account will be subject to a $50.00 administrative late payment fee for each occurrence. In the event of imposition of such fee, subsequent payments received will be applied first to cover the fee, and then the remaining amount of the payment will be applied to the reservation balance.
All participants will be subject to an additional charge of $250 for taxes, prepaid shipboard gratuities and fees. This fee, like all other fees described herein, is nonrefundable.
Participant authorizes Nursecon At Sea to charge the credit/debit card indicated, or to debit directly from the bank account indicated according to the terms outlined in the Terms and elsewhere. If any given due payment falls on a weekend or holiday and cannot therefore be processed by NurseCon at Sea or its bank or credit card vendor(s), Participant understands, agrees and consents that any given payment may be executed on the next business day. This authorization will remain active and in effect until and unless Participant cancels it in writing. Participant agrees to notify NurseCon At Sea of any changes in Participant’s account information or of termination of this authorization at least 15 days prior to the next charging/debit date. Participant certifies that s/he is an authorized user of the billing method which s/he has chosen, and that s/he will not dispute the scheduled payments provided that the transactions correspond to the terms to which s/he has agreed. Participant is aware that there is a $50.00 administrative fee for returned, bounced or disputed charges, and that all fees charged or processed by NurseCon at Sea and/or paid to NurseCon At Sea for Participant’s Reservation are strictly nonrefundable.
Financial Responsibility. NurseCon At Sea will split financial responsibility among multiple Participants if requested. The Primary Participant, the person who initially created the reservation, shall ultimately be responsible for the entire cost of the reservation if other Participants with financial responsibility become delinquent. Late fees and other penalties may be transferred to the Primary Participant at any time if other Participants fail to make necessary deposits or payments towards the reservation on time.
During the registration process, one Primary Participant (“Primary”) will register the stateroom, enter their information, and the information of their roommate(s). During registration, the Primary will have the option to split payment responsibility with their roommate(s). If the Primary chooses the option to split payment responsibility with their roommate(s), a notification to join email will automatically be sent to the roommate(s) after booking is complete. If any roommate(s) fails to join the reservation and agree to financial responsibility for their portion of the reservation within 72 hours, then the payment responsibility falls back to the Primary that booked. If roommate(s) accept payment responsibility and then fall delinquent in their payments, the payment responsibility falls back to the Primary that booked. The Primary hereby agrees to be automatically billed for any uncollected funds based on their roommate(s) not joining the reservation or falling behind in scheduled payments within 72 hours of such action.
UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE ALLOWED TO SAIL IF ANY PORTION OF THEIR RESERVATION IS DELINQUENT OR CANCELLED DUE TO LACK OF PAYMENT. PENTALITIES, LATE FEES, AND CANCELLATION TERMS ARE THE ULIMATE RESPONSBILITY OF THE PRIMARY PARTICIPANT WHO CREATED THE RESERVATION.
Transferring Reservation(s). NurseCon At Sea Reservations are issued to and used by only the Participant(s) named in the reservation. Reservations are non-transferable without the express written permission of Nursecon At Sea. If such permission is granted, every reservation transfer will be subject to a $250 transfer fee for the Primary Participant and/or $150 for each Guest Participant. Substitutions/Transfers may be requested at any time up to forty-five (45) days prior to sailing and will be granted at the sole discretion of Nursecon At Sea.
Refund & Revocation Policy. NurseCon At Sea Reservation fees, funds and/or costs are strictly non-refundable. Nursecon At Sea will NOT accept refund or credit requests of any kind. All Reservations are the sole property of Nursecon At Sea. NurseCon At Sea may, in its sole discretion and at any time determined by Nursecon At Sea, cancel, revoke, or refuse from any individual or entity the following: Reservations, registrations, sponsorship, association, purchases, and/or travel reservations made through Nursecon At Sea. Nursecon At Sea will not be responsible for any penalty, fee, loss, or expense that might result from such action.
- Nursecon At Sea will NOT issue refunds under any circumstances. Any and all payments made to Nursecon At Sea are NOT refundable for any reason, including, without limitation, failure to use Reservations due to illness, acts of God, viral, bacterial or illness outbreaks and pandemics, travel-related issues, acts of terrorism, loss of employment and/or duplicate purchases. Nursecon At Sea will NOT issue refunds for Reservations that have been revoked or canceled by anyone for any reason. Under certain limited circumstances, explained more fully elsewhere herein, funds may, at the sole and exclusive option and decision of Nursecon At Sea, be converted into credits which can be used for a future Nursecon at Sea event and which are active and useable for a limited time.
- Unused Reservations have no monetary value and cannot be credited to future years or events. NURSECON AT SEA will NOT issue refunds or credits due to failure to redeem a discount coupon or customer credit during the reservation process.
- Use of a Reservation(s) by anyone other than the authorized individual will result in revocation of the Reservation(s) without refund.
- Failure to meet the guidelines of the Cruise Line, U.S. Customs and Border Protection, any government’s officials, or standard sailing requirements may result in the revocation of your Reservation without refund. Nursecon At Sea will NOT issue refunds for failing to meet these requirements under any circumstance.
- NurseCon At Sea and/or Cruise Line reserves the right to cancel or postpone the Event and/or any individual Reservation(s) at any time for any reason. Nursecon At Sea will NOT issue refunds for Events and/or Reservations that are cancelled or postponed. Cancelled or postponed Events and/or Reservations will result in Participant being issued a Nursecon At Sea credit for use at a future Nursecon At Sea Events, useable for a period of three (3) year.
- NurseCon At Sea credits do not guarantee availability of Reservations, staterooms, experiences, itineraries, classes, or other specific features on current or future Nursecon At Sea Events. All reservations are first come, first served and subject to availability. NurseCon At Sea credits are non-refundable, non-transferable, and have no cash value.
- NurseCon At Sea and Cruise Line reserves the right to change Participant staterooms, reservations, manifests, ports of call, schedules, enrollments, or any other Event details at the sole discretion of Nursecon At Sea, the Ship, the Cruise Line or any government’s authorities at any time for any reason.
Fuel Supplement Charges. Purchaser agrees that the Cruise Line hereby reserves the right to charge a fuel supplement charge at its discretion. “Fuel Supplement” shall mean any additional charge to defray a portion of Cruise Line’s fuel costs. The amount of fuel supplements and government fees and taxes collected are subject to change. Such charges will not exceed $10 per passenger per day, without prior notice should the closing price of West Texas Intermediate Fuel increase above $65 per barrel on the NYMEX (New York Mercantile Exchange Index). The Cruise Line may collect any fuel supplement in effect at the time of sailing, even if the cruise fare has been paid in full. NurseCon at Sea, at it’s sole discretion, may pass those charges on to Participants. These charges, if applicable, will be billed to Participants.
Cancellation Policy. No refunds, credits, or value of any kind will be provided to Participants for any reason in the event of cancellation by Participant. Fees already paid toward the Reservation will be converted to Administrative Fees, and Nursecon At Sea will have the option to resell the stateroom in question without compensation to the original Reservation holder.
Entry and Restrictions. A NurseCon At Sea Reservation allows the Participant(s) entry to specific defined events, but does not guarantee admission onto the Vessel. All participants must follow specific guidelines from the Cruise Line and government agencies – including but not limited to COVID-19 or other illness-related protocol — to gain access to the Vessel including but not limited to conduct, customs, health and safety policies. Failure to meet those guidelines may result in the delay or cancellation of your Reservation and your ability to participate in the Event. NurseCon At Sea will not issue refunds for failing to meet these requirements under any circumstance.
Refusal of passage for any reason by the Ship, Cruise Line, law enforcement/customs authorities, or any other entity with authority to refuse passage will result in cancelation of your Nursecon At Sea ticket without refund. Examples: 1. Anyone caught with contraband of any kind upon embarkation will lose their ticket; 2. Anyone with a customs, citizenship, immigration or documentation issue who is refused passage by the aforementioned authorities will lose their ticket without refund. 3. If you suspect that you are or might be pregnant, please check with the cruise line on their pregnancy policy. You may have to bring a doctor’s note, and with or without a doctor’s note they may have a policy stating that you cannot board the ship if you are beyond a certain stage of your pregnancy. In case of such refusal, your reservation will be canceled and no refund will be issued.
Refusal of passage includes removal from ship or denial of reboarding at any time.
Unused reservations, due to refusal of passage, inability to reach the Port in time to board and sail, or any other reason, have no value of any kind.
Medical services are available upon the ship for an additional fee, charged by and paid to the Ship, the Cruise Line and/or its medical vendor. NurseCon At Sea disclaims any liability in connection with medical services given by a third party. Participant voluntarily absolves Nursecon at Sea for any liability, and indemnifies Nursecon At Sea for any action arising therefrom.
Service Animals. Animals and/or pets of any kind, other than service animals which are recognized by and fall under the Cruise Line’s service animal policy, are not allowed on board the Vessel. Service animals must meet the requirements of the Cruise Line and advance arrangements must be made directly with the Cruise Line. Any creatures will be confiscated and quarantined as per the ship’s policy, and arrangements will be made for the animal to be processed and landed at the next port of call at the Participant’s sole expense. Recognized assistance dogs are subject to and must comply with national and EU Regulations regarding health, inoculations, training and travel. It is the passenger’s responsibility to have all necessary papers and make all necessary arrangements prior to the cruise and to be satisfied that the assistance dog can be carried to the ports of embarkation and disembarkation and that the dog is not prohibited from going ashore at the various ports of call.
NurseCon At Sea expressly and specifically disclaims responsibility of any kind for the treatment or well-being of such creature, or for any and loss or injury associated with the process described herein.
Damages Caused By You. Anyone who damages any part of the ship or its contents will be responsible to the Cruise Line for paying for the repair or replacement of the damaged property. The value of the damage and the charge therefor will be determined by ship personnel, and the charge to your account will be from the Cruise Line. Nursecon At Sea has nothing to do with these decisions or this process. Furthermore, you shall indemnify NurseCon at Sea and Cruise Line, and each and all of their agents and representatives, against all liability which NurseCon at Sea and Cruise Line may incur towards any person or company or government for any personal injury, death or damage to property caused directly or indirectly, in whole or in part, by any willful or negligent act or omission on your part. Cameras are taking video throughout the ship, and any accidental or purposeful damage will be available on recorded video for ship’s staff to review.
Privacy. Ports and ships are thoroughly covered by cameras which are recording at all times. Event staff will be taking still photographs and video, and each Participant, by virtue of participating in the Event, waives any and all rights to privacy while in the Port, on the Ship, and at any function or event associated with the Event. Photographs and/or audio/video recordings taken at the Events by Nursecon At Sea, or others on behalf of Nursecon At Sea, may include a Participant’s image, name, voice and/or likeness. By attending and/or participating in the Events, Participant hereby grants Nursecon At Sea permission to use, and to sublicense to third-parties, the Participant’s photograph, image, likeness, voice and statements for any purpose, including, without limitation, commercial purposes, without compensation or credit to the Participant, in any and all media now known or hereafter devised.
Alcohol policy, narcotics/contraband. Bringing beverages (alcoholic or non) aboard the ship in your luggage or on your person is strictly forbidden. Your bags are subject to search by law enforcement authorities and by Cruise Line security and third-party vendors. Prohibited items will be confiscated and not returned. Narcotics or other contraband may be destroyed and the passenger will be subject to arrest and prosecution at the discretion of local law enforcement and authorities. Prescription medications must be in their original prescription containers, as issued by a licensed pharmacy. Certain items, such as cannabis, are not recognized by the federal government as a legal, legitimate prescription medication, and are considered contraband for the purposes of the Terms.
Smoking policy; Cruise Ships have very specific policies regarding smoking which must be adhered to strictly for the safety of passengers and crew, the Vessel, the ocean and marine life. Designated smoking areas on the Vessel are outdoors and are limited. There is never any smoking of anything indoors, including in your stateroom. Please check the ship’s policies for the current stance on vaping. The cruise line can and will impose and collect fines if they even suspect that you have smoked any material of any kind in your stateroom or elsewhere within the Vessel. Smoking areas will have ash and butt collection facilities. Throwing material of any kind, including but not limited to smoking materials, off of the ship is a hazard, is against maritime law, and will subject you to fines and possible ejection from the event.
Reservations Cannot be Prizes. NurseCon At Sea Reservations may not be used as a prize or incentive in any form of promotion, contest, game, or sweepstakes without advance written approval from Nursecon At Sea.
Vending. NO VENDING OF ANY KIND IS ALLOWED AT THE EVENT, except by individuals or entities expressly authorized by NurseCon at Sea. Unauthorized vendors’ goods are subject to confiscation and forfeiture. Unauthorized vendors are subject to the cancelation of their reservations and participation, and discharge from the ship at the next scheduled port without refund.
No Tampering with Reservations. Tampering with any Reservations, including, without limitation, Badges and/or Credentials (e.g., modifying, tearing, cutting, taping, etc.) is not permitted. If tampering is evident, the applicable Reservation(s) will be invalidated and confiscated, and Participant will not be allowed entry to any/all Nursecon At Sea venues and Events where the Reservation(s) is required.
NurseCon At Sea Lost and Found. NurseCon At Sea is not responsible for lost or damaged items dropped off at the Reservation Help Desk during the Events. Lost and Found will be located at the Help Desk during the Events. Participants can drop off found items at the Help Desk during the Event. At the end of the event, unclaimed lost and found items may be disposed of at Nursecon At Sea’s discretion.
Respect and Responsibility. Participants agree to respect, hold responsible, and maintain a positive, supportive, and healthy community. NurseCon At Sea does not tolerate the encouragement or the act of any inappropriate behavior before, during, or after any Nursecon At Sea event which includes, but is not limited to: verbal or physical abuse, violence, the use of derogatory or discriminatory language, any form of harassment, racism, sexism, or any other disparaging or damaging language or behavior directed at any staff member, participant, ship’s employee, or any other person, whether in-person, via the Nursecon mobile app, through social media channels, email, phone call, or any other method of communication, both public and private.
NurseCon At Sea or Cruise Line may, in their sole discretion and at any time determined by Nursecon At Sea or Cruise Line, cancel, revoke, or refuse from any individual or entity their reservation or passage on the Ship for inappropriate threats, statements, and/or derogatory or discriminatory language or actions. Threats and/or attempts to disrupt the event fall under this policy. Nursecon At Sea will not be responsible for any penalty, fee, loss, or expense that might result from such action.
Insurance. Each participant understands that it is their responsibility to arrange appropriate insurance coverage in connection with their attendance at this Event, if they so choose. NurseCon At Sea highly recommends travel insurance. Depending on the policy chosen by the Participant, a relatively inexpensive travel insurance plan can mitigate some or all of the fees and costs which may be lost due to various unfortunate circumstances, some of which are described herein.
Travel Documentation. Federal requirements for travel documentation change from time to time. The latest requirements can be found here https://www.ncl.com/freestyle-cruise/cruise-travel-documents, and it is each Participant’s responsibility to bring the necessary documentation. Travel documentation must be a minimum of six months from expiration on the date of our scheduled returned. Be advised that the U.S. Customs and Border Patrol sometimes reviews incoming ship’s manifests for passengers with outstanding warrants, and can and will arrest passengers upon arrival to the U.S. In the event that a Participant arrives for embarkation without the required documentation and is denied boarding by the ship, cruise line or authorities, that Participant’s reservation will be canceled without refund, and may be resold by Nursecon At Sea without obligation to refund or return any funds to the canceled Participant.
Age Policy. NurseCon At Sea reserves the right, without any refund of any kind, to refuse entry to any person who is not at least 18 years old with a valid ID on the date of the start of the event.
Voluntary Participation & Assumption of Risk. Participant understands that participating in Nursecon At Sea Events is voluntary and may involve certain risks of physical injury, damage to property, and other damages or losses that may be sustained by a Participant. Participant assumes all risk of damage, property loss, and/or personal injury which may occur by participating in the Events. NurseCon at Sea LLC expressly disclaims any responsibility for personal injury, property damage, loss, delay, inconvenience, or other matters due to negligence, wrongful acts, errors or omissions on the part of any third party, or any supplier of services of goods or of agents selected by you or your travel agent.
Additional Nursecon At Sea Policies. Participant has read, understands, and agrees to the Terms, Conduct Policy and Privacy Policy applicable to the Event. Participant is purchasing a Reservation(s) to attend, which policies are incorporated herein by this reference. (See the Nursecon At Sea Privacy Policy at www.nurseconatsea.com/privacy and Conduct Policy at www.nurseconatsea.com/conduct). Passenger understands and agrees that from time to time and for a variety of reasons it becomes necessary to rearrange cabin assignments. When this happens, guests will be assigned to a cabin of the same value or greater than the guest’s original assignment.
Personal Information. The NurseCon At Sea website uses cookies as a collection tool along with personal data that you share with Nursecon At Sea to tailor marketing to your interests, deliver the goods/services you purchase from Nursecon At Sea, and to enhance and customize your experience on the Nursecon At Sea website and at the event. LIMITATION OF LIABILITY. IN NO EVENT SHALL NURSECON AT SEA, NOR ANY AGENTS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, SUCCESSORS IN INTEREST, ASSIGNS, STAFF MEMBERS, CONTRACTORS, ASSOCIATES OR OTHER RELATED PARTIES BE LIABLE TO ANY PARTICIPANT, OR ANY OTHER PERSON OR ENTITY FOR ANY PERSONAL INJURY, DAMAGES TO PROPERTY, OR PECUNIARY LOSS, INCLUDING ANY DIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES, ARISING OUT OF ANY PARTICIPANT’S USE OF THE RESERVATIONS AND/OR PARTICIPATION IN THE EVENTS, EVEN IF NURSECON AT SEA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PARTICIPANT HEREBY WAIVES, RELEASES, AND DISCHARGES NURSECON AT SEA AND ITS PAST, PRESENT, AND FUTURE AGENTS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, OR DAMAGES, WHICH PARTICIPANT HAS OR MAY HAVE, ARISING OUT OF ANY MATTER WHATSOEVER. THE PARTICIPANT IS WAIVING HIS/HER RIGHT TO ANY RECOVERY, COMPENSATION, OR OTHER LEGAL, EQUITABLE, OR INJUNCTIVE RELIEF FROM NURSECON AT SEA FOR ANY REASON. NURSECON AT SEA SHALL NOT BE RESPONSIBLE FOR ANY DIRECT OR INDIRECT LOSS OR DAMAGE OF ANY SORT INCURRED AS THE RESULT OF THE SERVICES OR INFORMATION PROVIDED IN CONNECTION WITH THE EVENT OR ANY FUTURE NURSECON AT SEA EVENTS.
NO WARRANTIES. EXCEPT AS MAY BE EXPRESSLY SET FORTH IN THESE TERMS, PARTICIPANT’S PARTICIPATION IN THE EVENTS, AND ALL SERVICES AND PRODUCTS PROVIDED IN CONNECTION WITH THE EVENTS, ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, AND NO OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR OTHERWISE, ARE MADE WITH RESPECT TO THE SAME, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR SAFETY, OR ANY WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING. NURSECON AT SEA EXPRESSLY DISCLAIM ANY WARRANTIES NOT EXPRESSLY STATED HEREIN.
Indemnification. Participant agrees to indemnify, defend, and hold Nursecon At Sea and its affiliates, officers, employees, volunteers, contractors, suppliers, and representatives harmless from and against any and all claims, demands and all other liabilities, including, without limitation, costs and attorneys’ fees, made by any third party arising out of or in connection with Participant’s use of the reservation(s) or Reservations, or any violation of the Terms by Participant.
Time Limit to File Claims; Binding Arbitration; Class Action Waiver. Any dispute, claim or controversy between you and any person traveling under your reservation and NurseCon at Sea arising out of or relating to any claims, losses, damages or expenses relating to or in any way arising out of or connected with this Agreement or the Event, or any alleged breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, and any claim for damages or personal injury, illness or death and any alleged violation of civil rights, discrimination, consumer, Americans with Disabilities Act or privacy laws, shall be determined by arbitration in Orange County, Florida before a sole arbitrator, in accordance with the laws of the State of Florida for agreements made in and to be performed in this State. The arbitration shall be administered under the commercial arbitration rules of the American Arbitration Association. The arbitrator shall be permitted to award only those remedies in law or equity which are requested by the parties, or one of them, and allowed by law. In no event shall the demand for arbitration be made after the date when institution of legal or equitable proceedings based on such claim, dispute, or other matter(s) in question would be barred by the applicable statute of limitations. The arbitrator shall reject any claim not based upon a timely filed demand. Judgment on the Award may be entered in any court having jurisdiction.
In the arbitration Award, the arbitrator shall allocate all of the costs of the arbitration (and mediation, if applicable), including the fees of the arbitrator and the reasonable attorneys’ fees of the prevailing party, against the party who did not prevail.
NOTWITHSTANDING ANY PROVISION OF LAW OF ANY STATE OR COUNTRY TO THE CONTRARY, NO ARBITRATION DEMAND (OR SUIT IF THE CLAIM IS NOT SUBJECT TO THIS ARBITRATION PROVISION) SHALL BE MAINTAINABLE AGAINST NURSECON AT SEA FOR PERSONAL INJURY, ILLNESS OR DEATH, DAMAGES OR BREACH OF THIS AGREEMENT BY YOU UNLESS WRITTEN NOTICE OF THE CLAIM, WITH FULL PARTICULARS, SHALL BE DELIVERED TO NURSECON AT SEA AT ITS PRINCIPAL OFFICE WITHIN SIX (6) MONTHS FROM THE DATE THAT THE INJURY, ILLNESS, DEATH, DAMAGE OR BREACH OCCURRED AND DEMAND FOR ARBITRATION (OR SUIT IF THE CLAIM IS NOT COVERED BY THIS ARBITRATION PROVISION) IS COMMENCED (FILED) WITHIN ONE (1) YEAR FROM THE DATE OF SUCH INJURY, ILLNESS, DEATH, DAMAGE OR BREACH AND PROCESS SERVED WITHIN 120 DAYS AFTER FILING.
THE CRUISE LINE TICKETING CONTRACT, NOT THIS AGREEMENT, SHALL GOVERN ANY DISPUTE BETWEEN YOU AND THE CRUISE LINE.
YOU AND EACH PERSON TRAVELING UNDER YOUR RESERVATION HEREBY AGREE THAT EXCEPT AS PROVIDED IN THE LAST SENTENCE OF THIS PARAGRAPH, YOU MAY BRING CLAIMS AGAINST NURSECON AT SEA ONLY IN YOUR INDIVIDUAL CAPACITY. EVEN IF THE APPLICABLE LAW PROVIDES OTHERWISE, YOU AGREE THAT ANY ARBITRATION OR LAWSUIT AGAINST NURSECON AT SEA, SHALL BE LITIGATED BY YOU INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS OR REPRESENTATIVE ACTION, AND YOU EXPRESSLY AGREES TO WAIVE ANY LAW ENTITLING YOU TO PARTICIPATE IN A CLASS ACTION. IF YOUR CLAIM IS SUBJECT TO ARBITRATION AS PROVIDED IN THIS SECTION, THE ARBITRATOR SHALL HAVE NO AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. YOU AGREE THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE ARBITRATION CLAUSE SET FORTH IN THIS SECTION, AND IF FOR ANY REASON THIS CLASS ACTION WAIVER IS UNENFORCEABLE AS TO ANY PARTICULAR CLAIM, THEN AND ONLY THEN SUCH CLAIM SHALL NOT BE SUBJECT TO ARBITRATION.
Choice of Law. These Terms are governed by the laws of the State of Florida, without regard to its principles of conflicts of laws. Participant and Nursecon At Sea hereby irrevocably submit to the exclusive jurisdiction of the United States federal and state courts located in Orlando, Florida and agrees that any such court will be the proper forum for the determination of any dispute arising hereunder.
Updates to Terms. NurseCon At Sea reserves the right to make changes to the Terms at any time without notice to Participant, so please check back and review the Terms from time to time. To request an updated copy, please email [email protected]
General Provisions. Nothing in this Agreement establishes an agency, partnership, or joint venture between the parties, or relationship of employer or employee, between the parties (or between either party and the other party’s personnel). Headings are included for convenience only and will not be used to construe these Terms. In the event that any term or provision of these Terms is held invalid, illegal, or unenforceable in any respect, such invalidity, illegality or unenforceability will not affect any other term or provision hereof (which will remain in effect), and the parties agree thereafter to use their best efforts to substitute a provision of similar economic intent and effect.
HEALTH AND FITNESS TO TRAVEL
Passenger warrants that he/she is fit to travel by sea and that their conduct or condition will not impair the safety of the Cruise Ship or inconvenience the other passengers. Any passenger with a condition that may affect his/her fitness to travel is strongly encouraged to check with their personal physician regarding their ability to travel and to obtain a written physician’s certificate of Passenger’s fitness for an international sea voyage. The Master or the Cruise Ship’s Doctor in their sole discretion that a Passenger is for any reason unfit to travel, likely to endanger health or safety, likely to be refused permission to land at any port, or likely to render the Company liable for Passenger maintenance, support or repatriation, then the Company or the Master shall have the right to take any of the following courses and the Company shall have no further liability to Passenger: (i) Refuse to embark the Passenger at any port; (ii) Disembark the Passenger at any port; (iii) Transfer the Passenger to another berth or cabin; (iv) If the Cruise Ship doctor considers it advisable, to place and confine the Passenger in the Cruise Ship’s Infirmary, Passenger’s cabin or any other cabin, or to transfer the Passenger to a health facility at any port, all at the Passenger’s expense. Passenger acknowledges that travel by sea involves certain risks and hazards including motion of the Vessel by sea conditions and the delay and/or impossibility of immediate evacuation from the Vessel in the event of a medical emergency depending on the Vessel’s location and prevailing sea and weather conditions. NurseCon at Sea shall have no liability and shall owe no full or partial refund or credit in the event the Passenger is refused passage, disembarked, confined to the infirmary or their cabin, or transferred to another berth or cabin pursuant to this section.
Participation in the ship’s lifeboat drill prior to or shortly after sailing is mandatory for all passengers, crew and staff, without exception. Failure to participate can result in discharge from the ship at the next port, at the captain’s sole discretion, without refund.
With the exception of Nursecon At Sea’s cancelation and refund policies, the terms and conditions and/or policies of the Cruise Line supersede any of the Terms and shall prevail where there is ambiguity or conflict. All Passengers must abide by all directives issued by the Cruise Line or are subject to sequestration or removal from the Ship without refund of any fees due or paid.
